The Secretary of State for the Council of Ministers In a media release issued by Fretilin July 2, 2009, Jose Teixeira writes “We (Fretilin) request you be honest with our (media) releases.”

The Secretary of State for the Council of Ministers and The Spokesperson of the IV Constitutional Government, Mr. Agio Pereira responded, “As requested by our esteemed colleague Mr. Jose Teixeira, I would like to take this opportunity to be “honest” with the Fretilin media releases, but first I believe we should put some context around such media releases.”

“If you track the Fretilin media releases, they have accused everyone of corruption - the Prime Minister, both Vice Prime Ministers, most of the Government and their families, the President, advisors, the media and most recently the World Bank, the donors, and believe it or not, even western nations are not exempt,” cited Pereira.

In 2007, in a letter to the editor of the Australian newspaper protesting an article written by Greg Sheridan Fretilin Still a Stranger to Democracy, Jose Teixeira wrote “Timor-Leste is not an ‘Australian project’, and nor does it need long term ‘Australian handholding’ of the type advocated by Greg Sheridan, especially when that hand-holding means Australian involvement in a coup to topple a democratically elected government as occurred last year.”

“If bad press means Australia is involved in a coup then should we be concerned now Mr. Teixeira?

Are we in threat of a foreign invasion? I am quite sure Kevin Rudd and his Government have far more pressing matters to contend with like peace keeping.’

“Or could it be that bad press is simply bad press, you cannot have it both ways.” said Pereira “But as long as Fretilin is using the media by circulating the Australian articles as factual resources within their own propaganda, let’s look at what Greg Sheridan had to say post election.”

“Fretilin is thus facing a Hamas-like moment. It must decide whether it is essentially an armed militia or a respectable political party committed to the democratic process, which means accepting the result when it loses’.

‘Fretilin has been absurdly idealised in this country. It was always a Marxist and profoundly undemocratic movement. It failed in government. Its leaders say they are not ordering or even sanctioning this week's outbreak of violence. But these were Fretilin mobs that were rioting and Fretilin's leaders could have stopped the riots.’

Over a year later, on Feb 6, 2008, Estanislau da Silva, Fretilin MP and former Prime Minister made an ominous statement to the ABC. “We live in a peaceful country, the situation is very peaceful now it is not because of the government, it is because Fretilin tolerate, Fretilin have decided not to call for any action that could endanger the security and stability of this country.”

Pereira continued, “Let's hope Fretilin continues with this policy but most notably, the difference between Fretilin then and now is that they have miraculously transformed into the crusaders for righteousness, the chivalrous knights of the Alkatiri order.”

On June 19, 2006, a media release from the Fretilin Government was issued from the Office of the Prime Minister, Mari Alkatiri, entitled “Re-hashed Arms Story Rejected by the Timor-Leste Government.” The release was issued in response to articles that appeared in the Australian media defending a contract awarded to the Prime Minister’s brother. The media release states :

“One hard fact in today's reports in The Age and Sydney Morning Herald is that the company headed by Bader Alkatiri imported 257,000 rounds of ammunition at the end of 2004 for the police force,”said Mr Antoninho Bianco, Minister in the Presidency of the Council of Ministers of Timor-Leste.“The reports failed to include that this purchase was the result of an open tender, designed with the input of foreign advisers, conducted in a fully transparent manner,” said Minister Bianco.

“This ammunition purchase is not the basis for any scandalous allegation against anyone in my government,” Bader Alkatiri is the brother of the then Prime Minister Mari Alkatiri. Mari Alkatiri is currently the Secretary General of the Fretilin party.Prime Minister Gusmao has requested international audit teams ‘put their fingers on all wounds.”

“Do not hesitate to tell us what is wrong,” said Prime Minister Gusmao, “because only acting like this, can you help the Government to effectively tackle the challenges of reforming the financial management system of Timor-Leste.”

Pereira concludes, ‘The facts are The IV Constitutional Government is functioning within democracy, reforming inadequate systems that Fretilin established to serve the party.’

‘Prime Minister Gusmao is establishing new systems and achieving. In 2008, our nation was the second fastest growing economy in the world within a stable and peaceful environment. The IDP’s have all returned to their homes, pensions are being paid to the most vulnerable, our security forces are working harmoniously and the recorded 12.8% economic growth provides our nation with great prospects for our development.’

‘Prime Minister Xanana Gusmao has achieved because he and his Government have worked together with the President, the Parliament, the private sector, the public sector, the donors, our geographical neighbours and our people in this mandate. The successes of Prime Minister Gusmão are a living test, building a reality which keeps Fretilin operators like Teixeira and Arsénio Bano in a permanent cycle of nightmares.” ENDS

Local Government laws under discussion in the East Timor National Parliament
UNMIT Local Governance Monthly Bulletin July 2009 - In the beginning of June the National Parliament started to discuss the set of three Loc a l Government l aws submitted by the Ministry of State Administration and Territorial Managment (MAEOT).

Following the approval of the law for the Suco Elections, the law on Admininstrative and Territorial Management of Timor-Leste was already approved and is waiting Promulgation by the President of the Republic, Dr. Jose Ramos-Horta. The organic law on Local Government and the municipality law are currently being discussed in the National Parliament.

The approval of these laws are an important step for the decentralization process and towards the creation and development of the municipalities in Timor-Leste. A Local Government Dissemination campaign will be launched to explain the decentralization process as a means to promote an effective and equal provision of services for the people in order to strengthen economic and social development.

“We are expecting that the three laws will be promulgated by the end of July or the beginning of August. Rede ba Rai calls for effective public consultation on the draft Land Law


30 Organisations in over 12 countries, support the Land Network’s call for effective public consultation on the draft Land Law

Press Release – 30th June – For Immediate Release Over 30 organisations in 12 Countries have endorsed a set of measures that would ensure a fair and effective public participation on Timor-Leste’s draft Land Law. Today the Timor-Leste Land Network (Rede ba Rai) wrote for a second time to the Minister of Justice, Lucia Lobato, urging her to adopt these measures for the government’s public consultation process.

The new land law will determine who owns land in Timor-Leste. It will have far reaching effects on the nation’s social, cultural, economic and ecological development.

Inês Martins from La’o Hamutuk, a Land Network member said “We are very eager to support the development of a good law. Public consultation is crucial to find the best workable solution on land issues in Timor-Leste. We first gave the Minister our recommended measures on 10th June. We are hoping that she will give more time for consultation so we can effectively work together on the land law.”

“This law will effect every single person in our nation” – Demetrio de Carvalho, Director of Haburas Foundation and Land Network Member.

“The information we have so far is that the process may be extended until mid-September. However two months is less than half the time we need for an adequate consultation.” said Ms. Martins.

“The public consultation meetings are starting before people have had an opportunity read the law. They need time to understand it and discuss it. It’s very complex. A one day meeting in each district is not enough time for people to learn about the law and provide constructive feedback.”

“To the best of our knowledge consultation meetings will start on Monday (6th July) but the timetable’s still not finalized.”

The Land Network’s letter notes it ‘is eager to coordinate extensive public consultation and information sharing’ and today asks the Minister;

· To outline how people at the Sub-District, Suco and Aldeia levels will receive information on this law and participate in the consultation process,

· To extend the consultation process until the end of October in order to facilitate submissions from rural communities

· To explain how public feedback will be recorded, reported to the public and considered for incorporation in the law.

Copies of the letter were also sent to the Prime Minister, President of the Republic, President of the Parliament, President of Commission A, Director of the National Directorate of Land, Property and Cadastral Services and the Director of Citizenship.

Minimum Requirements for Effective Public Participation on the Draft Transitional Land Law

10 June 2009

Public Information

· A public consultation period of at least 5 months. At least a month is needed to share information and promote public discussion on the draft law before public consultation meetings begin.

· A summary of key elements and concepts of the draft law which people with limited formal education can understand, to be released together with the draft law.

· A timetable of public consultations with dates and place names. This needs to be issued at the start of the process so that communities and civil society are aware of when consultations will occur in their area.

· Distribute the draft law, summary of key points and timetable of public consultations to all Suco councils, district administrators, other local governance organs and DNTPSC and Ita Nia Rai offices before the public consultations start. Post information about the consultation and timetable to all Sede Suco noticeboards.

· Make copies of the draft law, summary and timetable of public consultations available to other agencies, civil society organizations and members of the public. This will help to ensure fair distribution to all members of the community.

Public Meetings

· Ensure Ministry of Justice/Ita Nia Rai facilitated public consultation meetings are held, at a minimum, in all 13 districts with broad public participation.

· Devise a mechanism that reaches people at more local levels. For example, coordinate with civil society groups and district DNTPSC offices, and train Xefe Councils, in order to engage communities at the suco level, or at the very least in all sub-districts. 

· Make it clear in all announcements that all community members are invited to attend public meetings and take measures to actively encourage broad participation. We encourage meeting organizers to help facilitate transport for community members.

· Facilitators for public consultations need to provide specific opportunities for women participants to speak (not only by keeping it ‘’generally open” for women to speak). Facilitators should also ensure that people of all ages have an opportunity to speak.

· Public meetings to consult with communities should last at least 2 - 3 days. The first day to provide information, and the following day/s for communities to give their input and ideas.

· Hold public consultations in Tetum, with the flexibility to incorporate ideas and input in community languages (such as through informal translations by community members).

· Monitor public attendance and participation in consultation meetings to track the inclusion of vulnerable groups such as women.

· We encourage incorporating a variety of perspectives in public consultation meetings. This could include inviting speakers from civil society, academia, and customary land authorities to present.

Accountability

· Produce a publicly available and timely report to record input and suggestions from the public consultations. Determine the parameters of this report and who is responsible for it before public consultation begins. This will strengthen accountability for how public suggestions are incorporated into the draft amendments.

· Provide a statement to outline how public input is incorporated into the draft law.

Statement By The Spokesperson of the IV Constitutional Government, The Secretary of State for the Council of Ministers


Less than one hour after the National Parliament passed the Gusmao Government's Anti Corruption Commission on June 29th, Fretilin issued a press release claiming that the Gusmao Government's Anti Corruption Commission was actually their policy.

'The Timor-Leste National Parliament in a rare display of bi-partisanship today passed with near unanimity (no votes against but one abstention from a Fretilin member) its own anti-corruption law, in the process rejecting a draft that had been proposed by the Government over nearly one year.' wrote Jose Teixeira, the Fretilin party spokesman.

The Secretary of State for the Council of Ministers and Official Spokesman for the Fourth Constitutional Government bemused by the statement said 'In Australia there is a word called 'porkies' which means a distortion of the truth.'

‘Fretilin leaders seem to enjoy telling 'porkies''.

Fretilin's media release was set to compliment their latest round of false corruption allegations against Gusmao. The allegations, widely aired on the ABC, were aimed at minimizing the impact of Gusmao’s Anti Corruption Commission announcement. Pereira commented, “taking credit for the Anti Corruption Commission is not the most ridiculous ‘porky’ told to the media and reported by our friends at the Australian Broadcasting Corporation.”


On June 26, 2006 at the height of the crisis, Fretilin loyalist Arsenio Bano told the ABC that his party had twenty thousand Fretilin supporters ready to come into Dili to protest Mari Alkatiri’s resignation. When reporter Mark Colvin pried for more evidence regarding Bano’s claims, asking where all these so called Fretilin supporters were, Bano replied “It’s correct.... we have proof.....they are only ...well ….a half hour away.” Half an hour from Dili, they would have been highly visible, yet no military forces had spotted them.

'Fretilin's twenty thousand supporters never appeared’, Pereira commented, ‘These are probably the same phantom supporters who were supposedly to participate in Fretilins’ largest ‘peace march’ which was reported by the ABC to be imminent… for all of 2008.” Pereira also expressed his surprise over how much effort Fretilin was putting into its relationship with the ABC. On February 7, 2007, Fretilin’s Secretary General Mari Alkatiri and former Prime Minister blamed the ABC for his 'demise', threatening to sue for defamation. He claimed the ABC reported with ‘extreme political bias and the utmost ill will.’ Alkatiri added that had the allegations not been broadcast, he would have never resigned.

At the closing of that interview, reporter Anne Barker asked Alkatiri if he had the support of the country, he replied 'I can tell you clearly if there is a person who has the biggest support now in the country is Mari Alkatiri.' Pereira added, 'I am not sure which country Alkatiri was referring to…'

During the election Fretilin told the ABC they had video proof of Nobel Peace Prize laureate Jose Ramos-Horta, then candidate now President of Timor-Leste, buying votes. The video, of course, never materialised but The President's response to Fretilin's 'porky' has become folklore: 'Well, it's a bit like, you know, Imelda Marcos meeting with me and telling me Mr Ramos-Horta please don't collect too many shoes'.

Jose Teixeira, who now seems to be leading Fretilin's aggressive media campaign against the Government of Timor-Leste, seems to have racked up the most 'porkies'. In 2005, Jose Teixeira told the ABC that a national oil company would be set up 'within weeks'. Pereira added, 'It seems Fretilin leaders discovered having a National Oil Company did not suit their personal; therefore, their political interests.'

During the 2007 elections, José Teixeira told the ABC 'several thousand' Australian-led troops were intimidating Fretilin voters while 'trying to disrupt its rallies'. After the elections, Teixeira then claimed Australian troops had embarked on a 'doorknocking campaign aimed at intimidating Fretilin supporters to switch their allegiance to the new illegitimate government of Xanana Gusmao.'

Pereira added: 'Can anyone imagine the Australian troops on a political door knocking campaign throughout Timor-Leste?'

In November 2008, Teixeira told the ABC that Mari Alkatiri was just nominated the lead negotiator on Greater Sunrise, 'The only problem with this statement' said Pereira 'is either someone forgot to tell the Government Alkatiri was negotiating for us or someone forgot to tell José Teixeira he wasn’t the Minister for Natural Resources anymore.'

Later in 2008, Jose Teixeira told the ABC that Government was planning to use three hundred thousand (300,000) hectares of land, ‘more than half Timor's arable land’ to establish a bio-fuel industry, but in the same year he told the ABC the Government had used all the arable land for ‘big hotels and casinos'.

Pereira commented, 'Maybe all those big hotels are for all the bio-fuel workers migrating to Timor-Leste.'

Pereira concluded: 'The Fretilin propaganda machine should spend more time on Timor-Leste, instead of focusing on Australia and working to excite the Australian media; but this is understandable as they lack any social or fiscal policies. Now, Fretilin is claiming the initiatives of the Fourth Constitutional Government of Kay Rala Xanana Gusmao as their own, like with the Anti-Corruption Commission. Fretilin Opposition leaders seem to be very confused on their own mandate.' ENDS

Tomorrow in parliament the opposition will accuse him of corruption, nepotism and collusion.

Indonesian Army firm in setting up units on border with East Timor


Yemris Fointuna , The Jakarta Post , Kupang 30/06/2009 10:54 AM - The Indonesian Military (TNI) has remained resolute in setting up an infantry battalion and a tank unit in areas bordering East Timor in North Timor Tengah regency, East Nusa Tenggara, despite mounting pressure over the past few weeks.

The stance was disclosed Monday by Udayana Military Commander Major Gen. Hotmangaradja Pandjaitan in Kupang, after he led a tour of duty ceremony at the Wirasakti Military Command from Col. Winston Simanjuntak to Col. Dodi Usodo Hargo.

Simanjuntak said the regency borders directly with Oecusi district in East Timor and is important to efforts to stave off threats and disturbances from foreign parties.

The public protest, including that from the local Catholic Church, over the planned establishment of the two Army units, is on the grounds East Timor is not a threat to the country. Critics have said the people instead need more economic development such as in health care and education and not military facilities.

The regency administration and legislature have also expressed reservations over the proposed construction of the military units. The legislature even voiced its objection in a plenary session early June.

In response to this, Simanjuntak said the establishment of the new military facilities was part of the central government's program in the defence sector and was for the sake of the nation and state.

"The presence of the new units will provide immediate benefits for the people and spur economic growth in the area."

He added the TNI presence would benefit residents, especially in the event of natural disasters.

"It would not be easy for foreign parties to claim part of the country given the TNI's presence, because it will protect every inch of soil."

The units will be built on 20 hectares (ha) in the districts of Biboki Aneu, Biboki Fetleu and Insana.

"Construction would likely be completed in 2019," he said.

Separately, the Biboki traditional community forum, made up of 154 traditional leaders in North Timor Tengah, wrote a letter asking the TNI to stop their activities on a 60-ha area donated by local Hendrikus Makun, on behalf of the leaders.

The protest, according to the leaders, is because the area is part of a protected forest and a clean water source, a grazing area for livestock and their ancestors' burial grounds. The area remains important to lives of the Biboki traditional community.

East Timor President Jose Ramo Horta is defending Prime Minister Xanana Gusmao's approval of a multimillion dollar government contract to a company linked to the PM's daughter. 

Mr Gusmao has not been available to respond to revelations he approved a multi-million dollar contract to a company linked to his daughter and three other contracts to companies part-owned by the wife of another minister. 

But Dr Ramos-Horta says he fully supports Mr Gusmao.  "Just because someone became president, became prime minister, became a minister, does not mean his family all have to go into unemployment, all have to sell their business and stop," Dr Ramos-Horta said.

Contract Questions

Last week, Radio Australia revealed that Zenilda Gusmao, the prime minister's daughter, is listed in East Timor's 2008 business registry as a shareholder in Prima Food. 

Prima Food last year won a government contract to supply rice worth $US3.5 million. 

Kathleen Gonsalves, the wife of Minister of Economic Development Joao Goncalves, also has profited from government tenders signed-off by Mr Gusmao. 

Dr Ramos-Horta says the prime minister deserves the benefit of the doubt. 

"Allegations are allegations until they are proved by investigation and in court. Until such a time I have full confidence," he said. 

Deputy Prime Minister Mario Carrascalao says the prime minister is required to sign off on all government contracts exceeding $US1 million. But he says that doesn't make Mr Gusmao responsible for the whole process of awarding government contracts. 

"So he had to sign it. He doesn't have to look after the process, whether there are some of his relatives included there or not," Mr Carrascalao said. Mr Carrascalao says he is looking into the circumstances surrounding Prima Food's multi-million dollar government tender.  

The opposition Fretilin Party says it has not yet been able to voice its concerns in Parliament regarding the rice contract scandal. Tuesday's debating period was cancelled. 

The Opposition plans to voice its concerns in Parliament on Monday.

PNTL resumes primary policing responsibilities in Oecussi


30 June 2009, Dili - Prime Minister Kay Rala Xanana Gusmão and Special Representative of the Secretary-General of the United Nations (SRSG) for East Timor Atul Khare presided today over the ceremony marking the resumption of primary responsibilities for the conduct of police operations by Polícia Nacional de East-Timor(PNTL) in the District of Oecussi. 

The process started on 14 May when PNTL resumed primary policing responsibility in the district of Lautem. Today represents a second step in this process which is the result of a rigorous assessments conducted by joint teams composed of representatives of the Government of East Timor and UNMIT, including PNTL and UNPOL.  Agreement was also reached that the third step would be taken in Manatuto in the near future. 

The Government of  East-Timor and UNMIT are implementing the resumption process in a gradual manner based on joint assessments and on the preparedness of PNTL in each district and unit, in accordance with mutually agreed criteria. The UN Police will maintain their presence in the districts where the PNTL have resumed responsibilities, in order to support, provide advice and to monitor the PNTL, including in the area of human rights protection

The District of Oecussi is an 800 square kilometer costal enclave in the western half of the Timor Island. The District is separated from the rest of the country by Indonesian territory.
